| Installation Rights: | The non-exclusive and non-transferable licence to an Educational Institution to install and use the number of copies of the Software Materials provided by the Company under this Agreement and distributed by the Minister for the purposes hereinafter described. - the Software Materials are to be used only by students, teachers and other educational personnel solely within such Educational Institution and solely for the benefit of and in connection with the educational, non-commercial purposes of such Educational Institution. The end user license agreement accompanying the Software Materials (“EULAâ€) is hereby incorporated into this Agreement by reference and shall govern with respect to all license rights to the Software Materials granted under this Agreement, and the Minister, Educational Institutions, and all end users shall be bound by all the terms and conditions of such EULA, except as otherwise expressly provided to the contrary in this Agreement. All users, including the Minister, each Educational Institution and each end user of such Educational Institution shall agree to the EULA prior to accessing and/or using the Software Materials. The Minister is not authorized to vary or amend the terms of the EULA; nor to supersede the EULA when sub-licensing the Educational Institutions. | |
